Terms of Service
By creating an account or using Elnez (the "Platform," "Service"), including app.elnez.com and any associated sites, apps, and APIs, you agree to these Terms of Service ("Terms") and our Privacy Policy.
1. What Elnez Is
Elnez is a clipping-campaign platform. The platform operator ("we") publishes paid content campaigns ("Campaigns"). Registered users ("Clippers") create short-form video clips from campaign materials, post them to their own social media accounts, submit them for approval, and earn rewards based on the verified views their clips generate. Rewards accrue to a Clipper balance and can be withdrawn to a connected payout method.
Elnez is not a bank or money transmitter. Payments, balances, and payouts are processed and/or held by third-party financial partners (for example, Stripe, PayPal, Coinbase, and a sponsoring bank) under their own terms. We facilitate the campaign and reward workflow; we do not provide banking services.
2. Eligibility
You must be at least 18 years old to participate in paid campaigns or receive payouts. If your jurisdiction sets a higher age of majority, that age applies. By using the Service you confirm you meet these requirements, that the information you provide is accurate, and that you are not barred from using U.S.-based services under applicable sanctions or export laws.
3. Accounts and Authentication
You create an account using a one-time email code (passwordless) or a supported social login (Google or Discord). You are responsible for all activity under your account and for keeping access to your email and linked logins secure. Notify us immediately at clippings@elnez.com if you believe your account has been compromised.
Linked social accounts. To submit clips you must connect and verify the social media accounts (TikTok, Instagram, YouTube, X, Facebook) you will post from. You confirm you own those accounts and have the right to link them. Submissions must originate from a verified account you own.
Identity verification (KYC). Before your first withdrawal you must complete identity verification through our verification partner (Veriff) and any checks required by our financial partners. If you do not complete verification, or a financial partner withdraws approval, you may be unable to withdraw, and your account may be limited or suspended.
4. How Campaigns and Rewards Work
Campaigns. Each Campaign specifies the reward rate (e.g., $X per 1,000 verified views), per-platform minimum and maximum payouts, a total budget, accepted platforms, content requirements, an eligibility window, and an end date. We may require an application before you can submit.
Submitting clips. You must follow each Campaign's requirements. A clip must be submitted within the Campaign's eligibility window after posting (default 30 minutes) or it may be auto-rejected. Each clip must be original and unique; duplicate submissions are prohibited.
Review and approval. We may approve, reject (with a reason), or flag submissions. We may reject or remove a submission if it does not meet the Campaign requirements or these Terms, if there is a reasonable suspicion of fraud, or if the budget/maximum payout is reached or the end date passes. If we do not act within a reasonable window, a submission that has not been flagged may auto-approve. We may approve or reject by automated means.
Auto-payout on approval. Approving a submission enables recurring (e.g., daily) automatic payouts based on the verified views the clip accrues, never exceeding the Campaign budget or the submission's maximum payout. We may revoke approval ("withdraw approval") at any time, including if fraud is later detected.
Legitimate views only. Rewards are calculated on legitimate views only, as determined by us in our reasonable discretion. We exclude views that are generated or suspected to be generated by bots, scripts, macros, automated systems, view exchanges, or any inducement (prizes, payments, barter) intended to inflate counts. We may apply a holding period (e.g., ~24 hours) before releasing funds, monitor views after approval, deduct excluded views, and reverse payouts attributable to inauthentic activity.
Closing. Once a Campaign's budget is exhausted or its end date passes, the Campaign closes and no further rewards accrue. You are responsible for monitoring Campaign status; clips posted or submitted after close may be rejected.
5. Your Content and Licenses
You keep ownership of the clips and other content you create ("Your Content"), except for materials we or the campaign owner provide ("Campaign Materials"), which remain owned by their respective owners.
To operate the Service and the campaigns, you grant us and the applicable campaign owner a worldwide, royalty-free, sublicensable, irrevocable, perpetual license to host, use, reproduce, distribute, publicly display and perform, edit for formatting, promote, and create derivative works from Your Content and submitted clips, in all media now known or later developed, including for advertising and promotion. You also grant the right to use your name, handles, likeness, and voice as embodied in the clips for these purposes. This license is consideration included in your reward rate. You waive moral rights to the extent permitted by law.
You represent that you have all rights necessary to grant these licenses, that Your Content is original (except provided Campaign Materials), and that it does not infringe any third-party rights or violate any law or platform policy.
6. FTC Disclosure and Compliance
When posting clips, you must comply with the U.S. Federal Trade Commission's Endorsement Guides and all applicable laws. Where required, clearly and conspicuously disclose the sponsored/commercial nature of a post (for example, "#Sponsored" or "#Ad") in a way that is not buried or easily missed. Your statements must be truthful and reflect your genuine views and experience. Do not make false, misleading, or unauthorized performance or earnings claims.
7. Balance, Withdrawals, and Fees
Balance. Verified rewards accrue to your Elnez balance, shown as an available balance and a total balance. Your balance represents funds held for your benefit by our financial partners; it is not transferable to other users and may only be used as described in these Terms.
Withdrawals. Once verified (KYC) you may withdraw available funds to a connected payout method (e.g., bank/ACH, PayPal, crypto wallet, or supported local rails). The minimum withdrawal is $10. Before you confirm a withdrawal, we display the amount, payout method, destination, fee, exchange rate (for cross-currency payouts), estimated delivery, and net amount.
Fees. Withdrawal fees depend on the payout method and are disclosed before you confirm. Indicative schedule (subject to change; final values set in-app):

For payouts to a non-USD account, an additional currency-conversion (FX) spread of approximately 1%–3% may apply. We may update fees by updating these Terms or our published fee schedule.
Corrections. Review your transaction history and report any error promptly. We may correct errors, reverse transactions, and adjust balances for inauthentic views, chargebacks, refunds, fees, fines, or amounts you owe us or our partners.
8. Taxes
You are solely responsible for any taxes on amounts you earn. Where required, you must provide tax forms (e.g., W-9 / W-8BEN) before payouts can be issued. Rewards are paid without withholding unless required by law.
9. Acceptable Use
You agree not to: break the law; harass, threaten, or harm others; infringe intellectual property; commit fraud or manipulate views, engagement, or metrics; use bots, scripts, automation, or view exchanges; submit duplicate or stolen content; circumvent fraud or security controls; scrape or reverse-engineer the Service; or use the Service for money transfers unrelated to campaigns. Violations may result in rejected submissions, withheld or clawed-back payouts, suspension, or a permanent ban.
10. Suspension and Termination
You may delete your account at any time. We may suspend or terminate your account or participation, with or without notice, for violations of these Terms, suspected fraud, or as required by our financial partners or law. On termination we may withhold or reverse funds tied to fraud or unauthorized activity, offset amounts you owe, and remove your content. Confirmed botting or fraud may result in a lifetime ban, and you may not create a new account to evade it. Payment obligations and Sections 5, 11–17 survive termination.
11. Third-Party Services
The Service relies on third parties (social platforms, payment and KYC partners, hosting, analytics). Your use of those services is governed by their terms and privacy policies. We are not responsible for their acts, availability, or decisions (including a social platform removing your post or a financial partner declining a payout).
12. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee any minimum earnings, views, uptime, or that the Service will be error-free or uninterrupted. View counts and reward estimates are approximate.
13. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data. Our total liability for any claim is limited to the greater of the amounts we paid you in the 12 months before the claim or $100. You must bring any claim within one year of the event giving rise to it.
14. Indemnification
You agree to indemnify and hold harmless Elnez and its affiliates, officers, and agents from third-party claims arising out of your content, your use or misuse of the Service, your violation of these Terms or any law, or your infringement of any third-party right.
15. Intellectual Property of the Platform
The Service, including our name, logo, software, and design, is owned by us and our licensors. Except for the limited rights to use the Service granted here, no rights are transferred to you. You may not use our marks without prior written permission.
16. Dispute Resolution
Informal resolution first. Before filing any claim, contact us at clippings@elnez.com with your name, account email, a description of the issue, and how you'd like it resolved. We'll try to resolve it within 60 days.
Arbitration and class waiver. If unresolved, disputes will be resolved by final and binding individual arbitration, not in court, and not as a class or representative action. You may opt out within 30 days of account creation by written notice to 7901 4th St N STE 300, St. Petersburg, FL 33702. Small-claims and injunctive-relief exceptions; governing arbitration act and seat to be set by counsel.
17. General
Governing law: Florida law governs, excluding conflict-of-laws rules. Changes: we may update these Terms; continued use after we post updates means you accept them. Severability: if any provision is unenforceable, the rest remains in effect. No waiver. No assignment by you without our consent; we may assign freely. Entire agreement: these Terms and the Privacy Policy are the entire agreement between us. Electronic communications: you agree to receive notices electronically.
